TERMS AND CONDITIONS for Meet Us in Africa CC

Meet Us in Africa, founded in 1995 is trading in the name of Meet Us in Africa CC. The terms and conditions listed below form the contract between Meet Us in Africa and their clients.

RESERVATIONS

A reservation is made when the receipt of the booking form and deposit have been confirmed by Meet Us in Africa CC. Bookings by telephone should be confirmed in writing, fax or e-mail and received within 14 days and accompanied by the appropriate deposit and booking form. The booking form confirms that you have read the terms and conditions of the trip/tour with Meet us in Africa CC. Before the first 10% deposit is paid you receive details of the holiday you have chosen and departure dates. Deposits for overseas operators/private travellers are negotiated with the 'norm' being a 10% non refundable deposit 6 months before departure to secure bookings, and a final 'outstanding BALANCE' 8 weeks before departure.

FLIGHTS AND INSURANCE

Meet Us in Africa CC are not responsible for any airline flights. These must be done by the client with appropriate TRAVEL/HEALTH insurance being taken out in the UK before arrival. The client must notify Meet Us in Africa CC of the arrival and departure dates with the relevant airport names in South Africa.

FINAL ITINERARY

We agree to operate the holiday as per the 'final' itinerary presented and confirmed by the client/overseas operator, unless for your safety and comfort we deem it necessary to change this itinerary as situations may arise which are beyond our control. We therefore reserve the right to alter or curtail the itinerary. We also reserve the right to substitute leaders/guides or accommodation. You will be notified immediately, should this be necessary before the tour begins or whilst the tour is in progress. We reserve the right to cancel or change parts of the itinerary in the event of bad weather or by whatsoever cause, for your comfort and safety. This will be left entirely at the discretion of the organisers/guides of Meet Us in Africa CC.

The proviso with regards accommodation is 'or similar', which gives us the right to alter the accommodation as mentioned in the final itinerary. The contract is deemed to have been made at 12 Duncan Lane, Amberglen, in Howick, KwaZulu Natal, South Africa and is therefore governed by South African law and is subject to the exclusive jurisdiction of South African courts.

CANCELLATIONS

A cancellation can only be accepted in writing or by email and take effect on the date we receive it. Cancellations received twelve weeks or more before the holiday commences will involve the loss of deposit (10% non refundable).
Thereafter the following charges will apply:
  • Over 50 days before departure - deposit only (10% non refundable)
  • Between 35 and 50 days before departure - 50%
  • Between 35 and 20 days before departure - 75%
  • Under 20 days until the day of departure - 100%.
Percentages are of total holiday cost.

The insurance policy you have taken out may cover the cause of cancellation - check with the claims department. If you are obliged to cancel you may with reasonable notice, transfer your booking to a third party who satisfies all the conditions required by a person taking that holiday, but you will be obliged to pay for any additional cost resulting from the transfer. Should there be a death of one of the travellers we will endeavour to recover costs to the best of our ability and refund monies after our own costs, bank charges and the 10% non refundable deposit have been accounted for.

No compensation is payable if the balance is not paid on time and cancellation is caused. Should the client fail to join a tour or join after the tour has commenced or curtail the tour for any reason, be that health, death or otherwise, no refunds will be paid out to the client. Please ensure that you/ your clients take out cancellation and curtailment insurance to compensate for departure delays, missed flights

AIRLINES

It is beyond the control of Meet Us in Africa CC if Airlines change their schedule which may necessitate our amending the stated itinerary. No compensation is due from Meet Us in Africa CC where cancellation or change results from unforeseeable or unusual circumstances beyond our control. This includes war or threat of war, terrorist activity, riots, civil or political disorder, natural or nuclear disasters, epidemics, fires, floods, adverse weather conditions, Acts of God, strikes by air traffic controllers in the European Union or South Africa, no fuel availability preventing carriers, hoteliers and other suppliers from carrying out their duties.

INSURANCE & LIABILITY

We take all reasonable steps to ensure holidays/trips put out in our itineraries are properly arranged. The vehicle hire operators, hotels, lodges, hutted camps and restaurants we use are reputable. We carry Passenger, Public and Professional Indemnity Insurance and insure with SATIB, South African Tourism Insurance Brokers who are underwritten by Lloyds of London. For your own protection it is highly advisable to have adequate Travel Insurance cover from your country of origin. Please ensure you/your clients take out cancellation and curtailment insurance to compensate for departure delays and/or missed flights This is a legal requirement. It is a condition of joining one of our tours that you must be insured against Medical and Personal Accident Risks. The policy should also include emergency repatriation.

We do not accept liability for animal or snake-bites or bee-stings or other stings or spider bites, over which we have no control. We do not accept liability for any incident arising from a game drive or guided walk, whether contracted out or not, as wild animals are unpredictable and an indemnity should be signed by the clients to this effect before embarking on such a drive. We do not accept responsibility for any incident arising from any of the Parks Board Game drives or guided walks whether with South African National Parks Board or KZN Wildlife (KwaZulu Natal Parks Board) or drives by private game reserves. These drives and guided walks are done entirely at the clients own risk.

We cannot accept claims arising out of carriage by air or sea. We have no control over the carriers concerned and you are subject to their terms and conditions, some of which may exclude or limit liability in respect of death, injury, delay and loss of baggage or equipment. We do not accept liability for delays in air flights, ship or boat sailing times, or other conveyances used in carrying out our trips.

We accept no responsibility for losses or additional expenses due to delay or changes in flight or lost airline or ferry or boat excursion tickets, other services, weather, strikes, war, or Acts of God. All such losses will be borne by the passenger.

Meet Us in Africa CC, its employees, guides, suppliers or subcontractors shall not be responsible for any passenger or client or his successors in respect of any loss or damage sustained by the passenger or client, or his successors, or for personal injury or death arising from circumstances beyond the reasonable control including, but not limiting the generality of the foregoing, war, Acts of God, industrial disputes, civil strife, fire, flood, weather, any natural disaster, political unrest, riots, and terrorist activities.

Meet Us in Africa CC is not responsible for loss, damage, theft of luggage, cameras, binoculars, telescopes and personal belongings, or for personal injury, accidents or illness, death or personal injury unless arising out of our proven negligence and providing they are in the course of our/their employment at the time.

Due to power cuts in South Africa and given that schedule times of such cuts are not being adhered to, we, Meet Us in Africa CC, cannot guarantee the normal standard of meals from our providers. We commit to doing our best for you under these trying circumstances and will see that you do not 'go hungry'. But whilst the problems are being 'ironed out' we cannot take responsibility for food being 'cold' or other 'alternatives' being offered should our restaurants and accommodation establishments not be able to perform at their best and present you with what you have ordered. We would ask also that for the time being, you stay away from venison, pork and sea-food. Your understanding is much appreciated

Any claim arising shall be subject to South African Law, and you, your client and Meet Us in Africa CC agree to submit to the exclusive jurisdiction of the South African courts.. We accept no claims arising out of your own acts or omissions or those of a third party not connected with the provision of your holiday.

VISITING COUNTRIES

At all times it is advisable to follow the customs of the country you are visiting and comply with the laws and regulations which may be in force. You must conduct yourself in a manner deemed by the leader to be compatible with the tour. Meet Us in Africa CC reserves the right to send any client home, at their own expense, if they disrupt the tour through unreasonable or unacceptable behaviour. We will make no refund nor pay or be liable for any compensation.

CLIENTS' WELL BEING

We reserve the right that the tour leader, in conjunction with the appropriate medical advice if applicable and/or available, has the right to disqualify a client at any time during the course of the tour if considered necessary for the medical well-being or safety of the individual or, in the tour leader's opinion, the client's actions materially are affecting the enjoyment of the tour for the remainder of the group. Unfortunately there will be no reimbursement from Meet Us in Africa CC under these circumstances.

ROTATING SEATS

On all our tours we ask travellers to rotate seats in the vehicles each day, taking it in turn to sit in the more popular seats in the front and the less popular ones in the rear. This requirement applies to everyone so if there is some reason why you can't take your turn in the back of a vehicle (e.g. a bad back or travel sickness) please inform the Meet Us in Africa CC office at the time of booking to see if we can accommodate you on the particular tour of your choice. We regret that anyone failing to inform us of such limitations before the tour will be expected to rotate seats in the same way as everyone else.

Small group tours can sometimes call for a certain amount of tolerance for other travellers in order to ensure that everyone on the tour has an enjoyable time. We reserve the right to send home, at their own expense, persons unable or unwilling to conduct themselves in a manner compatible with the satisfactory operation of the tour.

Please note that in line with widespread conservation practices, the collecting of specimens of flowers and insects is prohibited on our tours. The export of such material is illegal, as is its importation into the United Kingdom.

WANDERING OFF ALONE

Clients will be expected to listen carefully to ALL the instructions of the experienced Satour guide at ALL TIMES AS THERE MAY BE LION AND OTHER DANGEROUS WILD ANIMALS & SNAKES OR CROCODILES. If you want to walk on an afternoon off or go for an early morning walk, please make sure that you tell the leader/s, so that we can advise you and take any necessary action should you be 'overdue'. Whilst we are travelling and stop en route we ask that clients do not wander off alone and become separated from the group at any time. This is part of the indemnity to be signed by all clients before departure OR on the booking form.

SURCHARGES

All our prices are based on exchange rates at the time of going to press either as a requested itinerary, on the Meet Us in Africa CC website, or as a verbal quote and we reserve the right to make reasonable adjustments if the pound falls in value or the SA Rand firm below what our prices are based on. In certain circumstances we may levy a surcharge on trip prices involving transport costs including fuel and any other operational increases such as accommodation, meals and excursions.

We will absorb any minor fluctuations of up to 2% of the full tour price. Any fluctuation above this 2% will be communicated to the client immediately. Anything above this will be surcharged until 10% is reached. If the latter is reached you are entitled to cancel your booking and apply for a refund in writing. This refund will be less the bank charges both ways, and less the 10% non refundable deposit to cover our costs. To exercise this right, you must inform Meet Us in Africa CC in writing or by email within 14 days of the invoice date. Please confirm published prices at time of booking.

CURRENCY

We plan our tours many months in advance. Our prices are based on tourist exchange rates and all rates are equal to £1.00 sterling

BOOKING AND FINANCIAL SECURITY

Your monies will be held in Meet Us in Africa CC Bank account until deposits payable to accommodation establishments for your tour are due. In the unlikely event of something unforeseen happening in South Africa, like an accident, you can contact Meet Us in Africa CC's Accountant at G.C.Ford & Co. Chartered Accountants, 295a Greyling Str Pietermaritzburg, KwaZulu Natal, South Africa, 3201. Tel: +27 (0) 33 394 7616 to arrange a refund less the bank charges, fees for the execution of the transaction by the accountant and the non refundable 10% deposit, and less other monies which may have been paid by Meet Us in Africa CC in connection with your tour and may not be recoverable.

COMPLAINTS

If you have cause for complaint, it makes sense to sort out the problem on the spot, so that you can get on with enjoying the rest of your holiday. Please notify the leader so that it can be addressed immediately. If this is not done to your satisfaction please notify us in writing or by email within 10 days of your return.

NAMES AND ADDRESSES

We keep these on our computer system for use by Meet Us in Africa CC and no other parties. If you wish to be removed from our database please contact us by email or by post.

PARTY SIZE

The minimum size of group necessary for our tours to operate is four or at Meet Us in Africa CC's discretion. Our group size is usually ten clients with a maximum of twelve clients accompanied by two guides/leaders for a group of ten or more. To run the tour the minimum number must be confirmed six months before by payment of the 10% non-refundable deposit.
